1. Who we are

The Sun Will Come Up (“SWCU”, “we”, “us”) is a wellbeing app and website built around a simple idea: no matter how dark things get, the sun always comes up. The app offers daily sunrise montages, journaling and gratitude practice, meditation, wellbeing videos, community events, charitable giving, and an optional AI companion called Nova.

The data controller is SWCU CIC, a community interest company registered in England and Wales, company number 17194340, registered office C/O DJH, Military House, 24 Castle Street, Chester, Cheshire, CH1 2DS. You can contact us about anything in this policy at hello@thesunwillcomeup.app.

2. What information we collect

Information you give us:

Account details: your email address and password when you create an account.
Journal and gratitude entries: your reflections are private to you. They may reveal information about your mood, health or personal life, and we treat them with the highest level of care (see section 4).
Nova conversations: messages you exchange with the Nova AI companion (paid feature) are processed by our AI partner, LovingIs AI, to generate Nova's responses.
Photos and quotes you share: if featured, they may be shown to other users in the daily montage or quote cards.
Payment information: payments are handled by our payment providers (Stripe, and Apple or Google if you pay through an app store). We never see or store your full card details.
Correspondence: if you email or contact us through the app or website.

Collected automatically: device type, operating system, app version, language and time zone; which features you use and when; cookies and similar technologies (see our Cookie Policy).

3. How we use your information

To provide the app (your account, journal, montage, videos and events); to provide Nova's conversations if you subscribe; to process subscriptions and donations; to send you service messages (marketing only with your consent, always with an unsubscribe link); to keep the service safe and comply with our legal obligations; and to understand, in aggregate, how the app is used so we can improve it.

4. Your journal is private

Journal and gratitude entries are yours. They are stored securely, are not read by our team except where strictly necessary, are never sold, and are never used for advertising.

Because journal entries can reveal information about your physical or mental health, UK data protection law treats such content as special category data. We process it on the basis of your explicit consent, which you can withdraw at any time by deleting your entries or your account. If you choose to let Nova read your journal to personalise its support, that sharing happens only with your explicit permission, controlled in the app's settings.

5. Legal bases we rely on

Performance of a contract: delivering the service you signed up for.
Your consent: journal content, journal-to-Nova sharing, and marketing.
Legitimate interests: security, improvement and support, always balanced against your rights.
Legal obligation: for example tax and accounting records.

6. Who we share information with

We do not sell your personal data. We share it only with service providers who help us run SWCU, under contracts that protect your data: Supabase (database, sign-in and storage), Vercel (hosting), LovingIs AI (Nova conversations, and journal context only with your permission), Stripe, Apple and Google (payments), Wix (marketing website), and embedded media providers (for example Descript or YouTube), which have their own privacy policies. We may also share information if required by law, or where necessary to protect someone's vital interests.

7. International transfers

Some of our providers store or process data outside the UK. Where they do, we rely on safeguards recognised under UK law, such as adequacy decisions or the International Data Transfer Agreement / standard contractual clauses.

8. How long we keep your information

Account data and journal entries are kept while your account is active; if you delete your account they are deleted within 30 days, except where we must keep records for legal reasons. Payment and donation records are kept for 6 years as required by UK tax law. Shared photos and quotes can be removed on request via hello@thesunwillcomeup.app.

9. Your rights

Under UK GDPR you have the right to: access a copy of your data; correct it; delete it; restrict or object to how we use it; take your data elsewhere (portability); and withdraw consent at any time. Email hello@thesunwillcomeup.app and we will respond within one month. You also have the right to complain to the Information Commissioner's Office at ico.org.uk or on 0303 123 1113.

10. Safeguarding

SWCU is a wellbeing tool, not a medical or crisis service. Nova is an AI companion and cannot provide professional mental-health care. If you are in crisis, please contact the Samaritans on 116 123 (free, 24/7), text SHOUT to 85258, call NHS 111 and select the mental health option, or dial 999 in an emergency. We encourage anyone struggling to reach out to these services or to organisations such as Mind.

11. Children

SWCU is intended for adults and is not directed at children under 16. We do not knowingly collect personal data from children under 16; if you believe a child has created an account, contact us and we will delete it.

12. Security

We protect your data with encryption in transit and at rest, access controls, and reputable infrastructure providers. No system is perfectly secure, but we take the protection of your journal and personal information seriously and review our practices regularly.

13. Changes to this policy

We may update this policy from time to time. If we make significant changes we will tell you through the app or by email before they take effect.
