Terms of Service
1. Welcome
These terms are an agreement between you and SWCU CIC, a community interest company registered in England and Wales, company number 17194340, registered office C/O DJH, Military House, 24 Castle Street, Chester, Cheshire, CH1 2DS (“SWCU”, “we”, “us”). They cover your use of The Sun Will Come Up app and website. By creating an account or using the service you agree to these terms.
2. What SWCU is, and what it is not
SWCU is a wellbeing companion: sunrise montages, journaling and gratitude practice, meditation, wellbeing videos, community events, charitable giving, and an optional AI companion called Nova.
3. Your account
- You must be 16 or older to use SWCU.
- Keep your login details safe; you are responsible for activity on your account.
- Give us accurate information and keep it up to date.
- You can delete your account at any time in the app's settings or by emailing hello@thesunwillcomeup.app.
4. Free and paid features
The core of SWCU is free: the daily montage, journal and gratitude practice, community events listing, free wellbeing videos, photo sharing and donations. A paid subscription unlocks premium features, including the Nova AI companion, premium wellbeing videos, the advanced meditation timer and exclusive subscriber events.
Billing. Subscription prices are shown before you pay and include VAT where applicable. Subscriptions renew automatically until cancelled; you keep access until the end of the period you have paid for. If you subscribed through the Apple App Store or Google Play, billing and cancellation are managed through your store account and the store's own terms also apply. If you subscribed on our website, payment is processed by Stripe and you can cancel from your account settings. We do not refund partial periods except where the law requires; your statutory rights (including under the Consumer Rights Act 2015) are unaffected.
Free trials. Where we offer a free trial, we will tell you its length and the price after it ends. Unless you cancel before the trial ends, the subscription starts automatically.
5. Donations
Donations made through the app support free community events in the UK and the work of The World’s Greatest Experiment, a US 501(c)(3) nonprofit turning contributions into clean water, food and opportunity for communities in need. Donations are voluntary and non-refundable except where the law requires. We publish information in the app about how donated funds are used.
6. Nova, the AI companion
- Nova is an artificial intelligence, powered by our partner LovingIs AI. It is designed to be warm and supportive, but it is software: it can be wrong, and it does not replace human relationships or professional care.
- Nova only reads your journal entries if you explicitly allow this in settings.
- Do not rely on Nova in an emergency. Use the crisis contacts in section 2.
- We may update, change or withdraw AI features as the technology and our partnerships evolve; if we withdraw a feature you have paid for, we will offer a fair remedy such as a pro-rata refund.
7. Your content
Your journal and gratitude entries are private to you. We claim no rights over them beyond what is needed to store and display them back to you (and, with your permission, to share them with Nova).
If you share a sunrise photo or a quote with the community, you keep ownership, but you give us a worldwide, royalty-free licence to display it within SWCU, for example in the daily montage or quote cards, for as long as it remains in the shared pool. You can ask us to remove a shared item at any time.
Only share content you have the right to share. Do not upload photos of identifiable people without their permission, or content that is unlawful, hateful, explicit or harmful.
8. Acceptable use
Do not misuse the service: no unlawful activity, no attempts to break, overload or reverse-engineer it, no scraping other users' content, and no attempts to access other people's accounts. Do not use SWCU to harass, harm or impersonate anyone. Community spaces must stay kind, we may remove content or suspend accounts that break these rules.
9. Our content
The app, its design, branding, montages, videos and other content belong to us or our licensors and are protected by intellectual property law. We give you a personal, non-transferable licence to use the app for your own wellbeing. Wellbeing videos and music are licensed from their creators; embedded media is subject to the provider's own terms.
10. Availability and changes
We work hard to keep SWCU available, but we cannot promise it will always be uninterrupted or error-free. We may change, suspend or discontinue features, and we will give reasonable notice of significant changes affecting paid features.
11. Ending the agreement
You can stop using SWCU and delete your account at any time. We may suspend or close accounts that seriously or repeatedly breach these terms; where fair, we will warn you first. If we close your account without cause, we will refund any unused subscription period.
12. Our responsibility to you
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under UK law. Subject to that, we are responsible for foreseeable loss caused by our breach of these terms or our negligence, and our total liability is limited to the amount you have paid us in the 12 months before the claim. We are not responsible for losses that were not foreseeable, business losses, or problems caused by events outside our reasonable control.
You use the wellbeing content at your own pace and discretion: consult a professional before starting new physical practices (such as yoga or qigong) if you have any health concerns.
13. General
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction (if you live in Scotland or Northern Ireland, you may also bring proceedings there). If any part of these terms is found unenforceable, the rest still applies. We may update these terms; significant changes will be notified in the app or by email before they take effect.
